Terms and Conditions – Souschaif (Bahrain)

1. Eligibility

1.1 You must be at least eighteen (18) years old to subscribe to or use the Souschaif Service. If you are under eighteen (18), you must obtain prior consent from a parent or legal guardian before accessing the Service.

1.2 By using the Service, you confirm that you are legally competent to enter into a binding agreement under the laws of the Kingdom of Bahrain.

1.3 You must ensure that the information you provide during subscription or registration is accurate, complete, and up to date. We reserve the right to suspend or terminate access to users who provide false or misleading information.

2. Subscription Service & Billing

2.1 The Souschaif Service is a premium digital subscription service that provides recipe recommendations, food waste reduction tools, and meal planning features.

2.2 In Bahrain, the Service is offered through local mobile operators including Zain, Batelco, and STC. Subscription charges are billed daily at BHD 0.25 (Zain) or BHD 0.30 (Batelco, STC), exclusive of VAT (10%).

2.3 Subscriptions automatically renew on a daily basis unless you actively unsubscribe. You can cancel at any time by following the unsubscribe instructions on the Platform or sending the appropriate SMS command (e.g., "UNSUB SC") to your operator's shortcode.

2.4 Charges will appear on your mobile phone bill or be deducted from your prepaid balance. All billing, collection, and refunds are managed in accordance with your operator's policies and the Telecommunications Regulatory Authority (TRA) of Bahrain.

2.5 No refunds will be provided once a billing day has begun, except where required by Bahraini law. Any technical issue or wrongful charge should be reported to your mobile operator or to Souschaif's support team within 7 days of occurrence.

2.6 Promotional campaigns, discounts, or free trials may be introduced periodically and are subject to their specific terms and time limitations.

3. Use of the Service

3.1 The Service enables users to upload photos of their fridge or pantry, generate AI-based meal suggestions, and access sustainability tips to reduce food waste.

3.2 You agree to use the Platform solely for lawful purposes. You may not use the Service to upload, distribute, or share content that is offensive, illegal, defamatory, or infringes upon third-party intellectual property rights.

3.3 You must not attempt to hack, reverse-engineer, decompile, or otherwise interfere with the functioning of the Platform.

3.4 The Platform may include links to third-party websites (such as Vivino for wine recommendations). Souschaif is not responsible for the content, security, or privacy practices of third-party services.

3.5 Any community features (such as recipe sharing) must be used responsibly. We reserve the right to remove user content that violates our standards or the law of Bahrain.

4. Intellectual Property

4.1 All intellectual property rights in the Platform and its content—including but not limited to software, design, recipes, graphics, and databases—are owned by Mobixas B.V. or its licensors.

4.2 You are granted a non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use.

4.3 Any unauthorized copying, modification, distribution, or public display of Platform content is strictly prohibited.

4.4 "Souschaif" and its logo are registered trademarks of Mobixas B.V. Any misuse of these trademarks is prohibited under Bahraini and international trademark law.

5. Privacy & Data Protection

5.1 We respect your privacy and handle personal data in accordance with our Privacy Policy and the applicable data protection laws of Bahrain.

5.2 We may collect and process information such as your name, phone number, subscription status, and activity on the Platform. This information is used to deliver services, manage billing, and improve user experience.

5.3 We implement reasonable administrative, technical, and physical safeguards to protect user data; however, we cannot guarantee complete security due to inherent risks in digital communications.

5.4 By using the Service, you consent to your data being processed and transferred internationally in accordance with our Privacy Policy.

6. Disclaimers and Limitations of Liability

6.1 The Service is provided on an "as is" and "as available" basis. We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 We do not warrant that the Platform will always function without interruption, error, or security vulnerability.

6.3 Souschaif is not liable for any loss or damage arising from your reliance on recipes, nutritional advice, or other content provided through the Platform.

6.4 To the fullest extent permitted by Bahraini law, Mobixas B.V., its affiliates, and partners shall not be liable for indirect, incidental, consequential, or punitive damages resulting from your use or inability to use the Service.

6.5 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence or fraud.

7. Termination and Suspension

7.1 You may unsubscribe from the Service at any time by following the instructions provided.

7.2 We reserve the right to suspend or terminate your access without prior notice if you breach these Terms, engage in unlawful behavior, or misuse the Service.

7.3 Upon termination, your right to access or use the Service will immediately cease. Fees already paid are non-refundable unless required by law.

7.4 We may retain certain data for recordkeeping and legal compliance after termination in accordance with our Privacy Policy.

8. Force Majeure

8.1 We are not liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labor disputes, or internet outages.

9. Amendments to Terms

9.1 We reserve the right to modify these Terms at any time. Updated versions will be published on the Platform and will become effective immediately upon posting.

9.2 Your continued use of the Service following such updates constitutes acceptance of the revised Terms.

10. Governing Law & Dispute Resolution

10.1 These Terms are governed by the laws of the Kingdom of Bahrain.

10.2 Any disputes arising out of or related to the Service shall be submitted to the exclusive jurisdiction of the competent courts in Bahrain.

10.3 Users are encouraged to contact customer support to resolve any billing or service-related complaints before initiating legal action.

11. General Provisions

11.1 These Terms, along with the Privacy Policy and any other supplemental terms, constitute the entire agreement between you and Mobixas B.V. regarding the Service.

11.2 If any provision is held invalid or unenforceable, the remaining provisions will continue in effect.

11.3 You may not assign your rights or obligations under these Terms without prior written consent. Mobixas B.V. may assign its rights at any time.

11.4 Any waiver of a breach shall not be deemed a waiver of any subsequent breach.

11.5 These Terms are provided in English and may be translated for convenience; in the event of any inconsistency, the English version shall prevail.
